Hagrid mentions at some point that not everyone sends their kids to Hogwarts. Some of them homeschool them in magic (and maybe in other subjects, or maybe send them to local schools), some send them abroad (like Lucius wanted to do with Draco).

So then in book7, Tom Riddle via the Ministry both bans muggleborn students from attending, and makes Hogwarts attendance mandatory for everyone else. No more sending your kids abroad for school, and no more homeschooling.

Basically no one knows what’s in it and it’s maybe poison but Massachusetts is the only state that holds carbonated water to the same health and safety standards as regular water so LaCroix is just doing nothing and hoping there’s no consequences
