I like how in Mario Sunshine Mario gets arrested despite having an alibi corroborated by upwards of six different people (his being on a fucking plane/out of the country for nearly every crime he was being tried for), tried but not permitted a defense lawyer or any testimony to be given in his favor, and convicted based solely on crude eye witness testimony which didn’t even match his description (the illustration is literally blue, just like the actual Shadow Mario).  Then within minutes of his sentencing, the actual perpetrator strikes again in broad daylight in front of even more witnesses, and attempts to kidnap someone, only to be stopped by Mario, but Mario is nonetheless still held responsible and held to the task of carrying out his sentence?

Isle Delfino is canonically a police state

I hope you realize that the whole incident was engineered by Peach as part of a non-hostile takeover of the island.

The paintbrush was commissioned by Peach to be created in secret and given to Bowser Jr. (He explicitly says it was “given” to him.) She also arranged for information about her trip to Delfino to be “leaked” to Bowser. He then arranged the framing of Mario (by exploiting the corruption of the Delfino justice system) as a way of making Peach vulnerable. However, Peach also planned for this by also commissioning a device specifically for the purpose of countering the brush (FLUDD) and arranging for its very convenient placement at the airstrip.

Everything then proceeded exactly as planned. She would be “kidnapped”, Mario would “save” her, and after the revelation of Bowser’s presence on the island, the Delfino government would be left in a very precarious situation. Not only were they harboring Bowser, they also wrongfully imprisoned the Mushroom Kingdom’s greatest hero and forced him into labor. That’s some serious political leverage. To avoid making things worse for themselves, they would be left with no choice but to allow themselves to be absorbed into the Mushroom Kingdom as a province.
